These Terms of Service ("Terms") govern your use of Hillway's website and property consultancy services. By accessing our website or engaging our services, you agree to be bound by these Terms.

4. Client Responsibilities
When engaging our services, you agree to:
- Provide accurate and complete information
- Respond promptly to our reasonable requests
- Pay fees as agreed in our engagement terms
- Comply with all applicable laws and regulations
5. Fees and Payment
Our fees are set out in our engagement letters. Unless otherwise agreed:
- Fees are exclusive of VAT
- Payment is due within 30 days of invoice date
- Late payments may incur interest at 3% above the Bank of England base rate
6. Intellectual Property
All content on our website and materials we produce remain our intellectual property unless specifically transferred in writing. You may not reproduce, distribute, or create derivative works without our permission.
7. Confidentiality
We maintain strict confidentiality regarding client information. We will not disclose confidential information except:
- With your consent
- As required by law or professional obligations
- To defend our rights in legal proceedings
8. Limitation of Liability
To the extent permitted by law:
- Our liability is limited to the fees paid for the specific service
- We are not liable for indirect, consequential, or punitive damages
- We maintain professional indemnity insurance as required by RICS

- Finally resolved through English courts
13. Force Majeure
Neither party is liable for delays or failures due to circumstances beyond reasonable control, including natural disasters, war, or pandemic.
14. Governing Law
These Terms are governed by the laws of England and Wales.
15. Use of Artificial Intelligence
In accordance with the RICS professional standard Responsible use of artificial intelligence in surveying practice (1st edition, September 2025), we disclose the following:
- Hillway uses AI tools to assist in the creation of training course content, research, and certain professional work products
- All AI-assisted content and outputs are reviewed, verified, and approved by qualified RICS professionals before delivery
- We maintain an AI Professional Oversight Record documenting our use of AI, the review processes applied, and the professional judgement exercised
- Where AI is used in client-facing service delivery, clients are notified in writing in accordance with RICS requirements
- Confidential client data is not uploaded to AI systems without explicit consent and prior risk assessment

16. Changes to Terms
We may update these Terms periodically. Continued use of our services after changes constitutes acceptance.
17. Entire Agreement
These Terms, together with any engagement letters, constitute the entire agreement between parties.
